CPS – Child Protective Services: Legally Kidnapped – Fight CPS
In this article we will discuss CPS Child Protective Services and how to protect your family if you are being targeted by CPS. There are various horror stories about CPS. CPS corruption throughout the United States has been documented by the media, family rights groups as well as private citizens. This doesn’t mean that children don’t need to be protected, and that all Social Workers are bad. This research shows, that children have been taken from families and put in foster care for bogus reports and unfounded allegations.
Don’t think it can’t happen to you.
Just recently a family was targeted by CPS after their daughter told her school counselor that her father had hit her on her leg. This was after the teenager wanted to leave the house without consent at night to meet with a boy, which was not the first time. One week later, in the early morning hours, they’d received a phone call from CPS.
CPS were at the school because they had received a report and needed to do a body check. They also wanted to meet the same day to speak with the parents. Overwhelmed for the moment, the parents agreed after the CPS Worker told the parents she wanted to see legs, arms, back and belly. They called back shortly after, to inform the school that they would like to be present for the body check. Unfortunately it was too late. Nothing had been found during the body check. The CPS worker asked the daughter personal questions such as:
Do your parents argue a lot?
Do you fight with your sibling?
After a quick reflection, this family did some research online. This is why the freedom of information on the internet is so important. The CPS case worker did not tell the parents what the allegations were, but stated the following:
1. I NEED to come to your house and speak with you.
2. Make sure your other child is present because I would need to ask some questions.
The mother told the case worker, (who made it seem like she wanted to inspect the home) that they would take advantage of their constitutional rights, and that nobody had the right to enter their home without a warrant. She also informed the CPS case worker that they will speak to their attorney first. The CPS case worker agreed.
How to Fight CPS
And this goes DOUBLE for CPS workers
After asking the CPS case worker some more questions on what more was required, as the body check had been done and they’d spoke to their daughter already. The CPS Case worker stated that the mother was making this into something it wasn’t. No “probable cause” was established and there are no signs of any neglect. The mother asked why CPS would need to speak to the other child.

They respectfully declined to have their other child interviewed. The CPS case worker then stated that they could meet at the office and that she would need to speak to the father. After stating that they would need something in writing regarding the allegations, the case worker declined. The CPS case worker also stated that they will not speak with an attorney. Since it is THEIR right to remain silent, this is what the family chose.
The CPS case worker stated, that if they would not call to schedule an interview she will not be able to close the case and that she would make a note stating that they were being uncooperative. That was the end of the conversation. The next step was to consult with their attorney and schedule an appointment with the family doctor to get the children examined to confirm that they were healthy. The lawyer advised the parents to not speak to CPS – Child Protective services, at all. Let them contact you. Anything else will go through the attorney.

If all you have received is a letter from CPS – Child Protective Services, or DSS “Department of Social Services” or one of the other social services names, all you need to do is contact your lawyer, and have him/her write a polite letter in return about them being more specific to the allegations being made and their need for a warrant to ask any questions. Really, that’s it!
CPS – The Domestic Terrorist at your front door
If you are ever approached by anyone from social services, keep in mind that regardless of what they say, most of them are certainly not there to “help” you. They may appear “nice” and “helpful,” but never lose sight of the fact that most of these individuals usually “believe” the anonymous allegations reported against a family.
You might want to end this quickly by letting them in, to show them you have nothing to hide as you are a good parent. DON’T. They are only there to gather evidence against you.
Even if they seem nice and harmless, remember, this is how child protective services makes money. To keep their jobs, they must take away children from their families. They are wolves in sheep’s clothing. They come to your door saying, “I’m just here to help.” The next thing you know, your children are in state custody and you are in court trying to prove your innocence.
Don’t allow them into your home without a proper warrant. They will lie, intimidate, and attempt to con their way into your home, but don’t allow it. Unless they have a properly issued warrant, signed by a judge, based on sworn testimony by a named person, they have no right to enter your home – unless they can pony up a possible danger to the child. Be polite while refusing entry. There’s nothing a DHS/CPS/DCFS worker likes more than for you to show anger and, especially, curse them.
They are usually accompanied by policemen, some of whom will push their way in. If this happens, you may sue each person involved personally (police officers and all authority figures are personally liable for damages when they exceed their lawful authority and exceeding their authority is not protected by the Good Samaritan laws) not for charging you, but for forcing his or her way in. Don’t get beat up trying top stop them in this case. Sue them later. You will probably need the money later.

You Have the Right to Remain Silent (Use It!)

2. Anything you say can and will be used against you in a court of law.
3. If you are under the age of 18, anything you say can be used against you in a juvenile court prosecution for a juvenile offense and can also be used against you in an adult court criminal prosecution if the juvenile court decides that you are to be tried as an adult.
4. You have the right to talk to an attorney before answering any questions.
5. You have the right to have your attorney present during the questioning.
6. If you cannot afford an attorney, one will be appointed for you without cost, before or during questioning, if you desire.

What is a Miranda warning? A Miranda warning advises people of their constitutional right to not answer questions or to have an attorney present before answer any questions. Must a police officer always advise a person of their Miranda rights before asking a question?
